No doctor–patient relationship is created unless a healthcare professional holding the appropriate practising qualifications expressly accepts you as a patient and establishes the professional relationship in accordance with applicable law.

MediGoMY and the Website Operations Partners do not become your treating healthcare providers merely because they assist with transmitting information, arranging an appointment, translating information, processing an enquiry or coordinating communications.

6. Scope of MediGoMY’s Services

Services that MediGoMY may provide or arrange include:

(c) collection and administrative organisation of medical records;

(d) administrative arrangements for medical second opinions;

(e) hospital and specialist matching;

(f) treatment-quotation and appointment coordination;

(g) coordination of communications between users and hospitals or medical teams;

(h) translation and language support;

(i) travel, accommodation, visa or transportation coordination;

(j) insurance or payment coordination; and

(k) general administrative follow-up before or after treatment.

Unless otherwise expressly and lawfully agreed in writing, these services are general information and administrative-coordination services and do not constitute medical diagnosis or treatment.

MediGoMY may decide whether to accept, continue, suspend or end an enquiry or coordination service based on the completeness of the information provided, service capacity, compliance requirements, hospital requirements or other reasonable considerations, subject to applicable law and any binding written agreement.

7. Role of Website Operations Partners

Website Operations Partners provide technical, marketing, administrative, maintenance or operational services only within their respective appointed scope.

Unless otherwise expressly agreed in writing and lawfully authorised, Website Operations Partners:

(a) do not provide medical advice, diagnoses, prescriptions or treatment;

(b) do not assess whether a patient is suitable for a particular treatment;

(c) do not select hospitals, doctors or treatments based on clinical considerations;

(d) are not responsible for verifying every professional judgement made by a hospital or healthcare professional;

(e) do not make medical decisions on behalf of hospitals, doctors, insurers, patients or MediGoMY;

(f) do not guarantee that a user will be accepted, receive an appointment, obtain a quotation or receive treatment;

(g) do not guarantee Website rankings, search-engine results, advertising performance, enquiry volumes, sales, completed transactions or conversion rates;

(h) do not guarantee uninterrupted or error-free Website operation or freedom from technical problems caused by third parties;

(i) are not responsible for conducting a complete independent verification of information supplied by MediGoMY, hospitals, doctors, advertisers or other content providers; and

(j) do not become healthcare providers, partners, agents, joint-venture parties or joint operators merely because they develop, promote, maintain or operate the Website.

A Website Operations Partner is responsible only for obligations applicable to its own conduct, systems, personnel and actual scope of work.

A Website Operations Partner does not automatically assume the independent medical, professional, statutory or contractual responsibilities of MediGoMY, any hospital, doctor, pharmacist or other third party merely because it performs work relating to the Website.

8. Independent Hospitals, Doctors and Healthcare Providers

Hospitals, doctors, clinics, laboratories, pharmacies and other healthcare providers introduced, displayed, contacted or arranged through MediGoMY will generally be independent third parties.

Those healthcare providers are independently responsible for:

(a) maintaining the necessary licences, registrations and practising qualifications;

(b) determining whether a patient is suitable for a particular service;

(c) conducting appropriate consultations, examinations and diagnoses;

(d) obtaining informed medical consent;

(e) providing treatment recommendations and treatment plans;

(f) prescribing medication;

(g) carrying out surgery, treatment or other clinical procedures;

(h) explaining risks, alternatives and expected outcomes;

(i) maintaining medical records;

(j) protecting patient information; and

(k) taking responsibility for their personnel, facilities, equipment, services and clinical outcomes.

Displaying, introducing or assisting a user to contact a hospital, doctor or service provider does not constitute a guarantee of that provider’s qualifications, performance, service quality, safety, availability or results.

9. Treatment, Medication, Side Effects and Subsequent Conditions

To the fullest extent permitted by applicable law, the Protected Parties are not responsible for:

(a) any side effect, adverse reaction, complication, allergic reaction, interaction or other consequence of any treatment, surgery, medication, prescription, medical device or clinical service;

(b) any known or unknown, common or rare, immediate or delayed side effect or complication;

(c) treatment failing to achieve an expected result;

(d) a condition failing to improve, becoming worse, recurring or producing new symptoms;

(e) a patient requiring additional examinations, medication, surgery, treatment, hospitalisation or rehabilitation;

(f) interactions between medication and other prescription medicines, non-prescription medicines, supplements, herbal products, traditional medicines, food, drinks or an existing medical condition;

(g) any diagnosis, prescription, treatment decision, clinical judgement, act, omission or delay of a hospital, doctor, pharmacist, laboratory, healthcare institution or other healthcare provider;

(h) consequences arising because a patient failed to follow a healthcare professional’s instructions concerning medication, follow-up appointments, examinations, treatment or emergency medical assistance;

(i) consequences arising because a patient failed to disclose their complete medical history, medications, supplements, allergies, pregnancy status, previous treatment or other material health information to a healthcare professional;

(j) inaccurate, outdated, incomplete or individually unsuitable information supplied by a hospital, doctor, pharmacy or other third party;

(k) outcomes arising from the patient’s constitution, genetics, age, pre-existing conditions, immune response or other factors that cannot reasonably be predicted or controlled; or

(l) any medical condition occurring after treatment, whether that condition existed at the time of treatment, was foreseeable at that time or only arose subsequently.

Users acknowledge that all medical treatments, surgeries and medications may involve risks and that individual patients may respond differently. No medical outcome can be guaranteed.

Users must obtain information directly from the treating doctor, pharmacist or healthcare institution concerning:

(a) the purpose of a treatment or medication;

(b) known risks and possible side effects;

(g) transmitting information to a healthcare provider selected or authorised by the user.

This work does not constitute medical review, diagnosis, clinical interpretation or medical advice.

Administrative personnel, Website personnel and Website Operations Partners are not required to identify errors, omissions, abnormal results, emergencies or possible illnesses within medical records.

(b) does not mean that MediGoMY or a Website Operations Partner has independently verified all relevant information;

(e) does not guarantee that a third party will accept, maintain or perform the arrangement;

MediGoMY and its Website Operations Partners may rely on information provided by users, hospitals, doctors, healthcare institutions, insurers, travel providers or other authorised parties without being required to conduct an independent medical, legal, financial or professional verification of every item.

Users must confirm all material information and arrangements directly with the relevant hospital, doctor, pharmacist, insurer, government authority or other service provider.

12. User Responsibility for Submitted Information

Users must ensure that the information they provide is accurate, complete, legible and current to the best of their knowledge.

Users must disclose information that may be relevant to medical arrangements, including:

(a) current symptoms;

(b) known diagnoses;

(c) medications and dosages;

(d) allergies;

(e) surgical and treatment history;

(f) pregnancy status;

(f) side effects or complications;

No Website Operations Partner is jointly or severally liable for the acts, omissions, representations, information, medical decisions, treatment outcomes or contractual breaches of MediGoMY, a hospital, doctor, pharmacist, user or other independent third party merely because the Website Operations Partner provides Website development, SEO, SEM, advertising, maintenance or operational support.

No director, officer, employee, member of personnel, contractor, consultant, agent or representative assumes personal liability merely because that person performs authorised work for a Protected Party.

23. Liability That Cannot Be Excluded

Nothing in this Medical Disclaimer excludes or limits:

(a) liability for fraud;

(b) liability for wilful misconduct;

(c) liability for death or personal injury that cannot lawfully be excluded;

(d) mandatory personal-data protection obligations;

(e) liability expressly accepted in a valid written agreement by the relevant party; or

Each party remains responsible for its own acts, omissions, personnel, systems and statutory obligations.
