1. Introduction and Scope
These Website Terms of Service & Use (“Terms”) apply to medigomy.com, its related webpages, landing pages, online forms, digital services and communication channels.
Please read these Terms carefully before accessing or using the Website, submitting an enquiry, uploading information, requesting or booking a service, making a payment or asking MediGoMY to provide any service.
By accessing or using the Website, you acknowledge that you have read and understood these Terms. When submitting a service request, uploading medical information or making a payment, you may be required to actively indicate your acceptance of these Terms.
If you do not agree with these Terms, you must stop using the Website and must not submit information, request services or make a payment.
1. About MediGoMY
MediGoMY is a healthcare-information, patient-support and medical-coordination platform operated by AGH GROUP HOLDINGS SDN. BHD.
Unless otherwise expressly and lawfully stated in writing, MediGoMY:
(a) is not a hospital, clinic, medical laboratory, pharmacy, insurer or emergency medical service;
(b) does not act as your treating healthcare provider;
(c) does not provide medical diagnoses, prescriptions or treatment;
(d) does not make clinical decisions on behalf of hospitals, doctors or other healthcare professionals; and
(e) does not guarantee acceptance by any hospital, any medical appointment, any treatment proposal or any medical outcome.
MediGoMY may provide general medical information, administrative organisation of medical records, hospital or doctor matching, coordination of medical second opinions, treatment-quotation coordination, appointment arrangements, translation, travel arrangements and other patient-support services.
2. Definitions and Protected Parties
“User”, “you” or “your” means an individual or organisation that accesses, browses or uses the Website, submits information, requests a service, makes a payment or uses the services on behalf of another patient.
“Patient” means the individual to whom the MediGoMY service relates.
“Website” means medigomy.com, its related pages, forms, communication channels, social-media pages and digital services.
“Services” means the general information, patient-support, medical-coordination, translation, appointment, travel-coordination and related administrative services that MediGoMY may provide or arrange from time to time.
“Third-Party Service Providers” include hospitals, doctors, clinics, laboratories, pharmacies, insurers, payment providers, banks, airlines, hotels, transportation providers, translation providers, social-media platforms, advertising platforms and other independent service providers.
“Website Operations Partners” include authorised external service providers and business partners that provide website design, development, hosting, maintenance, cybersecurity, SEO, SEM, website analytics, advertising administration, content management, enquiry routing, translation or other technical and operational services.
MediGoMY, AGH GROUP HOLDINGS SDN. BHD., the Website Operations Partners, and their respective directors, officers, employees, personnel, contractors, consultants, agents and representatives are collectively referred to as the “Protected Parties”.
The use of the term “Protected Parties” does not exclude any liability that cannot lawfully be excluded and does not automatically make one party responsible for the independent conduct or obligations of another party.
3. Other Applicable Documents
These Terms must be read together with:
(a) the Privacy Policy;
(b) the Cookie Policy or Cookie Notice;
(c) the Medical Disclaimer;
(d) the Patient Authorisation and Consent for Medical Coordination;
(e) the Explicit Consent for Cross-Border Transfer of Personal and Medical Data;
(f) any applicable service order, quotation or confirmation;
(g) the applicable refund and cancellation policy; and
(h) any written terms relating to a specific service.
If there is a conflict between documents:
(a) mandatory legal rights will prevail;
(b) written terms relating to a specific service will prevail over these general Website Terms, but only in relation to that service;
(c) a separately accepted service order or quotation will prevail over general pricing information displayed on the Website; and
(d) the Privacy Policy governs personal-data matters, while the Medical Disclaimer governs medical risks and limitations relating to the role of the platform.
4. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract before independently applying for or purchasing a Service.
The Website is not intended to allow minors to independently submit medical information or request Services.
Where the Patient is under 18 years old, the Patient’s parent, legal guardian or another person holding lawful authority must contact MediGoMY and provide the requested authorisation and identification documents.
If you use the Services on behalf of another adult, you confirm that you:
(a) have obtained that person’s lawful authorisation;
(b) are entitled to submit that person’s personal and medical information;
(c) have given that person the relevant privacy and service information;
(d) have obtained any consent required by applicable law; and
(e) will not make medical decisions outside the scope of your authority.
5. Limited Right to Use the Website
Subject to your compliance with these Terms, MediGoMY grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable right to access and use the Website solely for personal, lawful and non-commercial purposes.
You must not use the Website or Services for unauthorised commercial resale, data scraping, competitive analysis, fraud, unlawful activity or infringement of another person’s rights.
6. Prohibited Conduct
You must not:
(a) use the Website in violation of applicable law;
(b) impersonate another person or misrepresent your identity, qualifications or authority;
(c) submit false, forged, misleading, unlawfully obtained or unrelated third-party information;
(d) submit another person’s medical records without lawful authority;
(e) attempt to obtain unauthorised access to the Website, servers, accounts or information;
(f) bypass security measures, access controls or technical restrictions;
(g) upload viruses, malware, destructive code or harmful content;
(h) decompile, reverse-engineer or attempt to obtain Website source code, except where expressly permitted by law;
(i) use robots, crawlers, automated tools or other means to extract Website content in bulk;
(j) interfere with Website operation or impose an unreasonable burden on any system;
(k) copy, modify, republish, sell or commercially exploit Website content;
(l) publish defamatory, threatening, harassing, discriminatory, obscene or rights-infringing content;
(m) use the Website to distribute spam, unauthorised marketing or fraudulent communications;
(n) use the Website for unlawful medical, pharmaceutical, insurance or financial activities; or
(o) assist another person to carry out any prohibited activity.
7. A Service Request Is Not Acceptance
Submitting an enquiry, form, medical record or Service request only means that you have asked MediGoMY to consider providing the relevant Service.
Until MediGoMY expressly confirms acceptance:
(a) MediGoMY is not required to accept or process your case;
(b) no Service contract is formed;
(c) there is no guarantee that a hospital or doctor will review your case;
(d) there is no guarantee that a quotation or appointment will be provided; and
(e) no doctor–patient relationship is created.
MediGoMY may refuse, suspend or discontinue a Service for reasonable grounds, including:
(a) insufficient or unverifiable information;
(b) a request that falls outside MediGoMY’s scope or capacity;
(c) suspected fraud, impersonation or unlawful activity;
(d) inability to confirm a representative’s authority;
(e) an emergency or medical condition unsuitable for online coordination;
(f) refusal of the case by a hospital or third party;
(g) threatening, abusive or uncooperative conduct by a User;
(h) incomplete payment; or
(i) legal, regulatory, security or commercial risk.
8. Nature of MediGoMY’s Services
MediGoMY provides general information and administrative-coordination services.
MediGoMY may:
(a) collect and organise medical records;
(b) check whether documents can be opened, read or appear generally complete;
(c) transmit medical information to hospitals or doctors whom the User has authorised MediGoMY to contact;
(d) coordinate a medical second opinion;
(e) obtain preliminary treatment information or quotations;
(f) coordinate appointments;
(g) provide general translation or administrative summaries;
(h) coordinate information relating to insurance, payment, visas, flights, accommodation or transportation; and
(i) provide administrative follow-up.
These Services do not constitute medical diagnosis, prescription, treatment, medical advice or any guarantee of a medical result.
9. No Doctor–Patient, Agency or Partnership Relationship
Browsing the Website, submitting information, making an enquiry, making a payment or using a Service does not:
(a) create a doctor–patient relationship between the User and MediGoMY;
(b) create a doctor–patient relationship between the User and a Website Operations Partner;
(c) make MediGoMY or a Website Operations Partner an agent of a hospital or doctor;
(d) make a hospital or doctor an employee or agent of MediGoMY;
(e) create a fiduciary relationship between a User and a Protected Party;
(f) create a partnership, joint venture or joint-operation relationship between any Protected Parties; or
(g) make a Website Operations Partner responsible for the independent obligations of MediGoMY or a healthcare provider.
10. Medical Disclaimer
The Website and Services do not provide emergency medical services.
All medical diagnoses, treatment recommendations, prescriptions, surgeries, medications and clinical decisions are the responsibility of the relevant independent healthcare professional.
MediGoMY and the Website Operations Partners do not guarantee:
(a) the accuracy of any diagnosis;
(b) that medical opinions will be consistent;
(c) that a treatment is suitable for a User;
(d) that a medication is safe or free from interactions;
(e) that a treatment will not cause side effects, adverse reactions or complications;
(f) that a medical condition will improve;
(g) that a condition will not recur or deteriorate; or
(h) that any particular medical outcome will be achieved.

11. User Responsibility for Information
You confirm that, to the best of your knowledge, all information you provide is:
(a) true;
(b) accurate;
(c) complete;
(d) legible;
(e) related to the correct Patient;
(f) lawfully obtained; and
(g) reasonably kept up to date.
You must promptly provide material information that may affect medical coordination, including:
(a) current symptoms;
(b) known diagnoses;
(c) current medication and dosage;
(d) allergy information;
(e) treatment and surgical history;
(f) pregnancy status;
(g) significant test results; and
(h) other information reasonably requested by a hospital.
To the fullest extent permitted by applicable law, the Protected Parties are not responsible for consequences caused by inaccurate, incomplete, outdated, misleading, illegible or incorrectly attributed information supplied by a User.
12. Medical Records and User Content
“User Content” includes medical records, text, images, videos, documents, translations, messages, reviews and other information submitted through the Website or Services.
You retain any rights you lawfully hold in your User Content.
You grant MediGoMY and its authorised service providers a non-exclusive permission to use, copy, store, organise, translate, transmit and disclose User Content to the extent reasonably necessary to:
(a) process your enquiry;
(b) provide the requested Services;
(c) contact a third party whom you have authorised MediGoMY to contact;
(d) comply with legal and regulatory obligations;
(e) protect the systems and Services; and
(f) address complaints or legal claims.
You represent that:
(a) you are entitled to submit the User Content;
(b) the User Content does not infringe another person’s privacy, confidentiality, intellectual-property or other rights;
(c) you have obtained all required consents; and
(d) the User Content does not contain malware or unlawful material.
13. Administrative Organisation of Medical Records
MediGoMY or its authorised personnel may conduct document-completeness checks and administrative organisation but are not required to identify:
(a) abnormal test results;
(b) a medical emergency;
(c) an incorrect diagnosis;
(d) unsuitable treatment;
(e) medication interactions;
(f) omissions from the records; or
(g) a possible illness.
Administrative organisation does not constitute medical review or clinical judgement.
Users must have medical information reviewed and interpreted by a suitably qualified healthcare professional.
14. Translations and Summaries
Translations, interpretation and administrative summaries are principally provided for communication and coordination purposes.
Unless expressly provided by an appropriately qualified professional:
(a) a translation is not a certified medical translation;
(b) a summary may not contain all information in the original document;
(c) the original document remains the primary record; and
(d) all important diagnoses, risks, prescriptions and treatment instructions must be confirmed by a healthcare professional.
The Protected Parties do not guarantee that an automated, general or third-party translation will be completely accurate or suitable for clinical decision-making.
15. Artificial Intelligence and Automated Tools
Where appropriate, MediGoMY may use technology tools to assist with formatting, searching, classification, translation, general summarisation or customer support.
Automated content:
(a) does not constitute medical advice or diagnosis;
(b) cannot replace review by a doctor;
(c) must not be used independently to make a treatment decision; and
(d) may be inaccurate, incomplete or unsuitable for a particular Patient.
MediGoMY will not submit identifiable medical information to a third-party artificial-intelligence service unless the necessary assessments, notices, consents and security arrangements have first been completed in accordance with applicable law.
16. Hospitals, Doctors and Other Independent Third Parties
Hospitals, doctors, clinics, laboratories, pharmacies, insurers, travel providers and other third parties are independent service providers.
Each third party is independently responsible for:
(a) licensing, qualifications and regulatory compliance;
(b) professional and clinical services;
(c) informed medical consent;
(d) diagnoses, treatment, medication and medical outcomes;
(e) facilities, equipment and personnel;
(f) quotations, charges and refunds;
(g) data protection and medical records; and
(h) contractual performance.
An introduction, listing, link, information or coordination provided by MediGoMY does not constitute agency, a guarantee, an endorsement or joint operation of the third party.
17. Appointments and Acceptance by Hospitals
MediGoMY may assist with appointment or case-review requests but does not guarantee:
(a) acceptance of a case by a hospital or doctor;
(b) availability of a particular appointment date;
(c) that an appointment will not be cancelled or postponed;
(d) that a specified doctor will personally provide the Service;
(e) availability of a particular bed or facility;
(f) that a hospital will maintain the original treatment plan; or
(g) completion of a Service within a particular period.
An appointment is confirmed only when formally accepted by the relevant hospital or service provider.
18. Quotations, Prices and Additional Charges
Unless expressly stated to be a final fixed quotation, all treatment charges and third-party prices are preliminary estimates.
Actual charges may change because of:
(a) a change in diagnosis;
(b) additional examinations;
(c) treatment complexity;
(d) medication and medical supplies;
(e) changes to a surgery or treatment;
(f) the duration of hospitalisation;
(g) side effects or complications;
(h) hospital policies;
(i) exchange-rate changes;
(j) taxes;
(k) bank or payment-processing charges;
(l) insurance decisions; or
(m) other circumstances that cannot be confirmed in advance.
Unless expressly included in a written quotation, MediGoMY’s coordination fee does not include hospital, doctor, medication, examination, flight, accommodation, visa, insurance, transportation, banking or other third-party charges.
19. Payment
Where payment is required for a Service:
(a) the price and currency will be disclosed before payment;
(b) the User must pay through an accepted payment method;
(c) the User is responsible for ensuring that payment information is accurate;
(d) bank, payment-processing and foreign-exchange charges may apply separately;
(e) MediGoMY may suspend the Service until payment is received; and
(f) the User must not make a fraudulent, unauthorised or improper chargeback.
If a User disputes a charge, the User should first contact MediGoMY at Asiagenesishealth@gmail.com and provide the relevant payment details.
20. Cancellation and Refunds
Except where otherwise required by applicable law:
(a) a User must request cancellation in the manner stated in the Service confirmation;
(b) coordination, review, translation, appointment or administrative work that has already been performed may be non-refundable;
(c) amounts already paid to hospitals, doctors, translators, payment platforms, airlines, hotels or other third parties are subject to the relevant third party’s policy;
(d) non-refundable third-party charges are the User’s responsibility;
(e) a change of mind, failure to provide information, failure to attend an appointment or failure to obtain a visa does not automatically entitle the User to a full refund;
(f) MediGoMY may deduct the reasonable value of work already performed and costs that cannot be recovered; and
(g) any refund will be returned to the original payment method unless another lawful arrangement is agreed.
If MediGoMY cancels a paid Service that has not commenced and the User is not in breach, MediGoMY will refund the portion of the MediGoMY Service fee relating to the unperformed Service. MediGoMY is not responsible for amounts that cannot be recovered from a third party, except where applicable law requires otherwise.
21. Chargebacks and Payment Disputes
A User must not initiate a chargeback, payment reversal or payment dispute without reasonable grounds.
Where a chargeback is initiated, MediGoMY may provide the bank or payment provider with:
(a) the Service order;
(b) the User’s acceptance records;
(c) communication records;
(d) evidence of work performed;
(e) payment records; and
(f) other information reasonably required to resolve the dispute.
This provision does not restrict a User’s lawful right to raise a genuine dispute concerning an unauthorised payment or a Service that was not provided.
22. Visas, Insurance, Travel and Accommodation
MediGoMY may provide general information or administrative coordination but does not guarantee:
(a) approval of a visa;
(b) permission for a Patient to enter a country;
(c) that a flight will not be delayed or cancelled;
(d) that insurance will cover treatment;
(e) that a hospital will maintain an appointment;
(f) that a hotel or transportation service will meet the User’s requirements; or
(g) that a Patient is medically fit to travel.
The User is responsible for obtaining:
(a) a valid passport and visa;
(b) medical clearance to travel;
(c) appropriate travel and medical insurance;
(d) entry and health documentation; and
(e) all other required approvals.
23. Cross-Border Services
Overseas-treatment coordination may involve different legal systems, medical standards, languages, currencies, cultures, visa requirements, insurance arrangements and data-protection regimes.
The User is responsible for understanding and accepting the relevant risks of overseas services.
MediGoMY does not guarantee that foreign medical, regulatory, licensing, consumer-protection or data-protection systems are equivalent to those in Malaysia.
Cross-border transfers of personal and medical information are governed by the Privacy Policy and any applicable separate cross-border transfer consent.
24. Website Operations Partners
Website Operations Partners provide technical, marketing, maintenance or operational services only within their actual authorised scope.
Website Operations Partners are not responsible for:
(a) medical diagnosis or treatment;
(b) the conduct of a hospital, doctor or pharmacist;
(c) treatment side effects or medical outcomes;
(d) the accuracy of information supplied by medical-content providers;
(e) acceptance by a hospital, an appointment or a quotation;
(f) visa, insurance or travel decisions;
(g) inaccurate information supplied by a User; or
(h) the contractual obligations of MediGoMY or another independent third party.
A Website Operations Partner does not become a healthcare provider to the User, a partner of MediGoMY or a guarantor of another third party merely because it provides Website development, SEO, SEM, advertising, content publication, maintenance or operational services.
25. Website Availability
MediGoMY does not guarantee that the Website will:
(a) always be available;
(b) operate without interruption;
(c) be completely free from errors;
(d) be compatible with every device or software;
(e) be free from cyberattacks;
(f) contain links that remain continuously available; or
(g) transmit all information immediately.
MediGoMY may maintain, update, modify, suspend or discontinue part of the Website.
Users must retain their own copies of important information and medical records.
26. Account and Communication Security
If the Website provides account functions, the User is responsible for:
(a) protecting passwords and login credentials;
(b) not sharing an account with an unauthorised person;
(c) using secure devices and networks;
(d) immediately reporting suspected unauthorised access; and
(e) activities performed through the User’s account, except for unauthorised access not caused by the User.
The User agrees that MediGoMY may send necessary Service communications to the email address, telephone number or messaging account provided by the User.
27. Intellectual Property
The Website and its original content, design, text, graphics, logos, page layouts, software, databases, videos and other materials are owned by MediGoMY, AGH GROUP HOLDINGS SDN. BHD., the relevant Website Operations Partner or the applicable licensor.
Except where permitted by law or authorised in writing, a User must not:
(a) copy;
(b) modify;
(c) translate;
(d) republish;
(e) sell;
(f) license;
(g) create derivative works from;
(h) remove copyright or trade-mark notices from; or
(i) commercially exploit any Website content.
The MediGoMY name, logo and brand elements must not be used without authorisation.
28. User Feedback and Testimonials
Where a User voluntarily submits general feedback, suggestions or non-confidential comments, the User permits MediGoMY to use them for Service-improvement purposes.
MediGoMY will not publicly disclose an identifiable medical testimonial, patient story, photograph or before-and-after material without the User’s additional express consent.
Where the User consents to publication, MediGoMY may edit, translate, shorten or anonymise the material, provided that its substantive meaning is not misleadingly changed.
29. Third-Party Links and External Platforms
The Website may contain third-party links, logos, advertisements or content.
MediGoMY and the Website Operations Partners do not control third-party websites and do not guarantee:
(a) the accuracy of their content;
(b) the security of their websites;
(c) that their services are lawful or suitable for the User;
(d) that the third party will perform its obligations; or
(e) that the third party’s privacy practices are equivalent to those of MediGoMY.
A User accesses a third-party website at the User’s own risk and subject to the third party’s terms.
30. Privacy and Cookies
Personal-data processing is governed by the Privacy Policy.
The use of cookies and similar technologies is governed by the Cookie Policy or Cookie Notice.
A User submitting sensitive medical information may be required to complete a separate patient authorisation and consent.
Cross-border transfers, marketing, and audio or video recordings must be subject to separate consent where required by applicable law.
31. Suspension and Termination
MediGoMY may immediately suspend or terminate access or a Service in reasonable circumstances, including:
(a) breach of these Terms;
(b) non-payment;
(c) fraud or unauthorised activity;
(d) submission of unlawful or harmful material;
(e) threatening, harassing or abusive treatment of personnel;
(f) a risk to Patient, third-party or system safety;
(g) legal or regulatory requirements;
(h) refusal by a hospital or service provider to continue;
(i) inability to verify identity or authority; or
(j) the Service becoming impracticable.
Termination does not affect payment, confidentiality, intellectual-property, liability, indemnity or dispute-resolution rights that arose before termination.
32. No Warranties
To the fullest extent permitted by applicable law, the Website and Services are provided on an “as is” and “as available” basis.
The Protected Parties make no express or implied warranty concerning:
(a) merchantability;
(b) fitness for a particular purpose;
(c) non-infringement;
(d) complete accuracy or continuous Website availability;
(e) medical suitability;
(f) acceptance by a hospital;
(g) Service or commercial results;
(h) SEO rankings or advertising performance;
(i) treatment safety; or
(j) medical outcomes.
Any warranty that cannot be excluded under applicable law applies only to the minimum extent required by law.
33. Limitation of Liability
To the fullest extent permitted by applicable law, the Protected Parties are not responsible for indirect, incidental, special, exemplary, punitive or consequential loss arising from:
(a) use of or inability to use the Website;
(b) a medical decision or treatment outcome;
(c) medication side effects, adverse reactions or complications;
(d) the conduct of a hospital, doctor or third party;
(e) inaccurate or incomplete information;
(f) changes to an appointment, quotation or travel arrangement;
(g) differences in a translation or summary;
(h) a technical interruption;
(i) loss of information; or
(j) an event beyond reasonable control.
Such loss includes loss of profit, revenue, opportunity, reputation, data, anticipated savings, travel, accommodation and indirect third-party expenses.
34. Aggregate Liability Cap
To the fullest extent permitted by applicable law, the aggregate liability of MediGoMY and the relevant Protected Parties for all claims arising from or relating to a particular paid coordination Service will not exceed the amount of the coordination fee actually paid by the User to MediGoMY for that specific Service.
The liability cap does not include amounts paid directly to a hospital, doctor, pharmacy, insurer, airline, hotel, bank, payment provider or other third party.
Where a claim does not relate to any amount paid to MediGoMY, the aggregate liability will not exceed RM500, to the fullest extent permitted by applicable law.
This liability cap does not apply to liability that cannot lawfully be limited.
35. No Joint or Several Liability
Unless expressly required by applicable law, a Website Operations Partner is not jointly or severally liable with MediGoMY, a hospital, a doctor or another third party merely because it provides Website development, hosting, SEO, SEM, advertising, maintenance, translation or operational services.
Each party is responsible only for its own acts, omissions, personnel, systems and applicable obligations.
No director, officer, employee, contractor, consultant, agent or representative assumes personal liability merely because that person performs authorised work for a Protected Party.
36. Liability That Cannot Be Excluded
Nothing in these Terms excludes or limits:
(a) liability for fraud;
(b) liability for wilful misconduct;
(c) liability for death or personal injury that cannot lawfully be excluded;
(d) mandatory consumer rights;
(e) mandatory personal-data protection obligations; or
(f) any other liability that applicable law prohibits the relevant party from excluding or limiting.
37. User Indemnity
To the extent permitted by applicable law, a User must reasonably indemnify a Protected Party against third-party claims, regulatory investigations, loss or reasonable legal expenses resulting from the User:
(a) submitting another person’s information without authority;
(b) impersonating another person;
(c) supplying false or fraudulent information;
(d) unlawfully accessing or disclosing medical records;
(e) infringing privacy, intellectual-property or other rights;
(f) misusing the Website;
(g) uploading malware;
(h) violating applicable law; or
(i) seriously breaching these Terms.
A User is not required to indemnify a Protected Party for loss caused by that Protected Party’s own fraud, wilful misconduct or liability that cannot lawfully be excluded.
38. Force Majeure
MediGoMY is not responsible for delay or failure to perform caused by an event beyond its reasonable control.
Such events may include:
(a) natural disasters;
(b) epidemics or public-health events;
(c) war, civil unrest or terrorism;
(d) government restrictions;
(e) border closures;
(f) flight cancellations;
(g) hospital closures;
(h) internet or electricity interruptions;
(i) cyberattacks;
(j) third-party system failures;
(k) strikes; or
(l) supply-chain disruption.
39. Complaints and Disputes
A User with a complaint concerning a Service, payment or these Terms should first contact:
The User should provide:
(a) the User’s name;
(b) contact details;
(c) the relevant Service;
(d) the relevant payment or case reference;
(e) details of the complaint; and
(f) the outcome requested.
The parties should first attempt in good faith to resolve the dispute through written communication.
This provision does not restrict a consumer’s right to make a complaint or claim before a regulator, court or consumer tribunal having lawful jurisdiction.
40. Governing Law and Jurisdiction
These Terms and any contractual or non-contractual dispute relating to the Website or Services are governed by the laws of Malaysia.
To the extent permitted by applicable law, the parties submit to the jurisdiction of the courts of Malaysia.
This provision does not deprive a consumer of any mandatory jurisdiction or remedy available under applicable law.
41. Changes to These Terms
MediGoMY may update these Terms from time to time.
The updated version will be published on the Website together with its updated date.
A material change will apply only to use or Services occurring after the change takes effect, unless:
(a) retrospective application is permitted by law;
(b) the User expressly agrees; or
(c) the change is an administrative or technical amendment that does not materially affect the User’s rights.
A paid Service that has already been confirmed will generally remain subject to the Terms accepted when that Service was confirmed, unless a change is required by law or separately agreed in writing.
42. Assignment and Subcontracting
A User must not transfer the User’s Service contract or account without MediGoMY’s written consent.
MediGoMY may appoint suitable service providers or subcontractors to perform technical, administrative, translation, payment, communication or coordination functions, subject to applicable law and contractual responsibility arrangements.
MediGoMY may transfer these Terms and the relevant business relationship as part of a lawful corporate restructuring, merger, sale or business transfer.
43. Entire Agreement
For general Website use, these Terms and the policies expressly incorporated by reference constitute the entire agreement between the User and MediGoMY.
Oral communications, general advertising and Website marketing content do not amend these Terms or guarantee a medical outcome.
Any amendment or special commitment relating to a particular Service must be contained in a written document accepted by the relevant parties.
44. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable:
(a) it must be modified to the minimum extent required to make it enforceable while preserving its intended purpose as far as possible;
(b) if modification is not possible, the invalid part must be severed; and
(c) the remaining provisions will continue in effect.
45. No Waiver
A failure by MediGoMY or another Protected Party to immediately enforce a right does not constitute a waiver of that right.
A waiver relating to one breach does not constitute a continuing waiver relating to a later breach or any other breach.
46. No Third-Party Medical Guarantee
Unless these Terms expressly provide a limitation or protection for a Website Operations Partner, no hospital, doctor or other third party automatically becomes an agent or guarantor of MediGoMY under these Terms.
The services of hospitals, doctors and other third parties are governed by their own contracts, privacy notices and medical-consent documents.
47. Language
These Terms may be made available in English, Chinese and other languages.
The language versions are intended to convey the same meaning.
Any inconsistency must be resolved in accordance with applicable law. No language version may be used to reduce a consumer’s mandatory legal rights.
A Bahasa Malaysia version must be provided where required by Malaysian law.
